What has changed with the amendment of the Occupational Safety and Health Act?
With the amendment of the Occupational Safety and Health Act in June 2025, response to heatwaves has been strengthened into a legal obligation.
Now, hydration, provision of shade, guaranteed rest, and work suspension standards are not at the 'manager's discretion' but are 'legal requirements that must be implemented.'
A particularly noteworthy point is that the standard for 'temperature' is not the standard temperature, but the 'feels like temperature' that takes humidity into account.
It is difficult to meet legal standards with only a standard thermometer.
This is because it is necessary to accurately reflect the on-site risk that changes rapidly depending on humidity.
※ Mandatory legal obligations to check
● Hygrometer and thermometer always on standby: Measurement at a height of 1.2m to 1.5m from the workplace floor is mandatory.
● Measures by Heatwave Level: Activate the temperature control device and provide a break when the temperature exceeds 31℃; when the temperature exceeds 33℃, a break of at least 20 minutes every 2 hours is mandatory.
● Record and retention obligations: Record the perceived temperature and measures taken by date and retain them until the end of the year.
